Can my adult disabled daughter collect Social Security from her dad and her disability benefit too?

Full question: My ex husband began collecting his Social Security at age 62. We have an adult disabled daughter (disability began at age 2) and she receives her own SSDI. Is she allowed to claim part of her dads Social Security and keep her own SSDI?

Thank you for your question about your disabled adult child’s benefits.

If your husband is collecting his own retirement benefit and your disabled child is already collecting a disability or Supplemental Security Insurance, SSI, benefit, she may be eligible to collect a benefit based on your ex-husbands earning’s record if it is higher than what she is collecting on her own.

Also, we do not know your age, but you may be eligible for a child-in-care spousal benefit if you are taking care of a disabled adult child.
