What should I do if the Social Security Administration is using the GPO against me despite having a foreign pension?

Published: September 28, 2021

Full question: SSA are refusing to acknowledge that my U.K. pension does not trigger the GPO when I applied for survivor benefits. I have highlighted the relevant section to them. What should be my next step?

Hi there,

Foreign pensions are not considered as government pensions for purposes of the GPO provision, as specified in the first bullet of Section B, Payments That Are Not Pensions For GPO, in this reference from the Social Security Program Operations Manual.

If you believe the SSA has made a mistake with your benefits, the first step you can do is to call your local Social Security office or the main Social Security office and ask to speak with a supervisor on the matter. They may have you file a request for reconsideration.

Best of luck,
Martha
