What is the difference between the two pension rules, WEP and GPO, and how do they affect the benefits I am receiving?

Published: July 26, 2021

Full question: How can I claim the difference of spousal payment due to WEP? At my full age I filed for Social Security, but due to a foreign pension they reduced my benefit amount, that is under 1/2 my spouse’s PIA. They should add diff of spousal benefit, but they say by GPO no spousal benefit there.

Hello,

The WEP rule will affect your own retirement benefit amount if you are receiving a pension from an employer in the U.S. or another country.

The GPO rule affects dependent benefits, such as those for spouses and survivors, if you are receiving a pension from an employer in the U.S. If you are receiving a foreign pension, your spouse and survivor benefits will most likely not be affected.
