Do I owe the Social Security Administration money?
Published: July 7, 2025Full question: I got a letter from Social Security saying that they previously sent a letter that I may not require to pay back some or all of my SSI overpayments from March 2020 through September 2020 as part of a settlement agreement for the campos, et al. v. kijakazi class action lawsuit. In the settlement, we agreed to waive some SSI overpayments in any months from March 2020 through September 2020 without a person needing to request a separate waiver. we are writing to tell you that you had an overpayment within the time period of march 2020 through september 2020 that qualified for a waiver under the campos settlement. you no longer need to pay back $359 of your overpayment. It also said if you have an overpayment that is not waived under the settlement agreement, you may still request a waiver at any time. My question is: I did get a deposit in October 2020 of $2,322 which I called right after and asked if this was a mistake they said it was backpay, i got another deposit in December 2022 of $553 they said that was backpay also. I requested a letter of confirmation for these deposits but never got a letter will I have to pay this back at some point with the new administration rules because I won’t be able to pay it back. Can I request a waiver for those? I was living in a bad situation with my older brother where I was paying for everything that’s why me and my younger brother and I left him and moved out to different apartments. I have done the expenses for all those years if you need them. Can you help with the waiver? Is there anything I can do or that you can help me with?
Hello,
Thank you for reaching out regarding the letter you received about the SSI overpayment and the Campos settlement. It’s good to hear that part of your overpayment has been waived.
Regarding the deposits you received in October 2020 and December 2022, which were described as backpay, if you have concerns about whether these amounts may need to be repaid under new administration rules, the best course of action is to contact the Social Security Administration directly. They can provide you with the most accurate information regarding your account and any potential overpayments.
Here’s what you can do:
1. Gather all relevant documentation, including the letter about the waiver under the Campos settlement, records of the deposits you mentioned, and any expenses you’ve incurred.
2. Contact the SSA at 1-800-772-1213 to discuss your case. Be prepared to explain your financial situation and the hardship you experienced.
3. If necessary, you can request a waiver for any overpayment that is not covered by the Campos settlement. Be sure to mention your previous living situation and the expenses you’ve had.
Please remember that the SSA is experiencing a high volume of calls due to recent changes, so patience is advised. Keep monitoring for any updates and maintain records of all communications with the SSA.
If you have any further questions or need additional assistance, please don’t hesitate to reach out.
Wishing you all the best,
Martha and team
