Does my wife need to re-apply for benefits now that HR 82 has been signed?

Published: February 13, 2025

Full question: My wife applied for half of my Social Security in 2016, but she was denied due to her teacher pension and her Account was put on Suspension! But now HR 82 has been approved and Biden to sign soon, does she have to go back into her Social Security account and re-apply for her Social Security benefits or will she need need to do nothing because SS will automatically give her the benefits she deserves because she is on record as having applied back in 2016?

Hi there,

On January 5, 2025, President Joe Biden officially signed the Social Security Fairness Act (H.R. 82) into law. The Social Security Administration is currently working on implementation timing and procedure details to enact the new law. Beneficiaries should ensure their information is up to date via their MySocialSecurity account on SSA.gov for seamless processing. Keep up to date on further details by visiting the SSA Social Security Fairness Act webpage here.

All the best,
Martha
