I have a pension from the UK. How will the WEP affect me?

Full question: I am receiving ex spousal benefits and have just become eligible for my own benefits although I am over FRA. I have a U.K. state pension. How will WEP affect me.? Will I still receive the same spousal benefit that I was receiving before?

Hi there,

If you are receiving ex-spousal benefits and you are entitled to your own retirement benefits, you will receive the higher of those two benefit amounts.

Your retirement benefit will continue to increase until you collect it, up to age 70.

When you apply for retirement benefits, you may be subject to WEP. The reduction will vary depending on how many years you have worked in the US and contributed into the Social Security and Medicare program. If you have over 30 years of earnings counting towards Social Security the WEP rule will not apply.
