Question: Can I collect Social Security from my deceased husband even if I am still working?

Martha’s response: Yes, you may be entitled to collect survivor benefits based on your deceased husband’s earnings record and still work. You must have been married at least 9 months and be at least 60 to collect survivor benefits and 62 to collect retirement benefits. If you are working, collecting benefits, and younger than your full retirement age (between 66 and 67 depending on your birth year) you will be subject to the “earnings test” and a certain amount may be withheld from your check if you make over the earnings test threshold…Read the full response.

An important change to accessing online services: People who created an online SSA account before September 18, 2021, will soon be required to transition to a Login.gov account to continue access to their online services. Read the press release.

Who is eligible to receive survivors benefits? One may be qualified to receive Social Security survivors benefits if they are the surviving spouse, surviving divorced spouse, unmarried child, or even a dependent parent.

Who notifies the Social Security Administration of a death? It is important to notify Social Security as soon as possible when someone (a Social Security beneficiary) dies. A funeral director will typically report a death to Social Security.

Will (re)marriage impact my survivors benefits? Yes, getting married could potentially have an impact on your benefits.

What is a lump sum death payment? A one-time lump sum death payment of $255 can be made to a qualifying spouse or child if they meet certain criteria. It must applied for within 2 years of the date of death.
